Like seriously, rule #1 of dealing with police is playing dumb.

hmm why would i accept mail with my name and address on it? obviously i have personally asked for every piece of mail and every package i have ever gotten, and i know what it is in every single envelope and box before i open it 100% of the time. not once in my life have i ever wondered "hmm i wonder what this is?"

So... techincally... the cops knew without a doubt that there were drugs in the package... the alleged perp accepted a package addressed to him a metaphorical Schrodinger's Box there was no way for him to have certainty of the contents - especially since it was originally allegedly delivered to another address - the contents could've been changed etc...

I know he fucked up by accepting it, he should've said something like: thanks you can leave it at the door and let it sit for a few days and really waste the war on drugs money - or be sus af and deny a package addressed to him.

After he was arrested his only words should have been the name of his lawyer.

I am recreational user and stick to bud benzos and ambien and performance enhancing drugs - but my #1 speedial is still my lawyer - plus I have his number memorized and keep quarters on me just in case I go through bookings (you don't always get a complimentary phone call for all you law and order fans.)

I practice OPSEC like a paranoid schizo who thinks the cops are always out to get me. I have been pulled over before with enough drugs in my car to have me doing serious time - I respectfully ask what I did wrong - then proceed to answer the questions (yes sir - no sir ) when asked to search my car I say no sir - when pressed as to why not I simply say refer back to the reason I was stopped and said I don't see why you need to search my car for a failure to obey a traffic signal violation.

This visibly frustrated the cop, as he knew in his gut there was something in the car but had no reasonable cause to search my vehicle. He proceeded to escalate and say he can get a dog here to search my car.

I then said excuse me officer would you mind if I call my lawyer - he said ok. He proceeded to radio his Sargent to the scene ( No dog..)

I made a few calls to myself and listened to my voicemail until the Sargent came (less than 5 minutes.) I told the officer I am having difficult getting through and said I would try his cell phone.

I finally call my lawyer for real, briefly explained that I had drugs in my car, I was pulled over for a moving violation and I am not under the influence.

My lawyer asked to speak with the Sargent and in less than what seemed like a minute I was given my phone back - asked my lawyer what to do - he said I was fine to go home and put the drugs in a safe location and don't drive with them. I said okay thanks, how much do I owe you, he said 200$ , I said okay I will leave a check in your mailbox.

The phone call with my attorney is considered privileged and the officers cannot listen to my conversation. As although I was not arrested, I was not free to leave.

When I hung up I got out of my vehicle and asked the Sargent how much my ticket is going to cost. He said $138 if I plead guilty within 15 days - I then said "so I am free to go home now?"

The Sargent responds yes - the regular cop is red in the face pissed off.

I can only assume that the conversation that went down between my lawyer and LE was about what constitutes reasonable cause and that if they are to search my car they are going to have to get a warrant and no reasonable judge would grant one under the circumstances.

Always have a fucking lawyer I cannot stress this enough!

That 200 saved me - at least 72 hours in lock up (friday night) - thousands in lawyers fees - and almost certain jail time if they found the drugs - plus a loss of license since my piss would've been hot even though I wasn't under the influence.

If ever arrested for anything you have the right to remain silent except to say I would like to contact my attorney.

Sidenote: A family friend is a retired criminal court judge she said every single guilty verdict involved a defendant who said something - never once had she overseen a case where a guilty verdict from a defendant who stayed silent or called their lawyer.

Cuz the undercover they had do the CD was dressed in street clothes and said "hey man I found this package on 19 st do you want it ?" Than the dude said "ya I need that pack". Like wtf I'm trying to figure out what exactly happened.
