[GeneralQuestions] If a product doesn't arrive and the coins are in escrow, what rights does the consumer have?

hypothetical situation atm, not enough time has passed for me to know whether its coming or not but I want to know my right incase the worst happens

Vendor allows Escrow for international orders yet states that there is no insurance for lost orders.

What is the point in allowing Escrow then? You could literally just not ship the package and say 'I said no insurance' so that's literally the same as finalizing early as the escrow is useless.

Should I just dispute (Agora) anyway? Sounds like abuse of advertising escrow to me.

Dispute when you feel enough time has passed. What the vendor puts on their profile or whatever they say can't stop how escrow works. If you don't get your product you get a refund or a reshipping. Sounds like the vendor wants to run a Finalize early shop, or scam you. Either way, you have your coins in escrow and that gives you some power.

Not only this provisions may be against the DNMs rules, but also they are rationally against an agreement. When an agreement is made, both parties have obligations. If one of the parties has a "right" to unfulfill their obligations (in this case that would be not sending the product) but still has the right to make the other party fulfill its obligation, then we are not talking about a real agreement.

It would be different if the vendor had the possibility to demonstrate he had sent the order and it had been lost. But since that is impossible, those kind of statements are just trying to be wildcards to selective-scam and keep the escrow money. Therefore, they should be not taken into account.

I've had it happen once. If they can't provide tracking or any means to prove you received then you get a refund. Fracking Poppermachine....

If there isn't an escrow extension button, just dispute. I've done it quite a few times on EVO cause my post takes forever here and I just politely inform them that and that I'm not at all having a problem, just want to remain in escrow. Never had a problem and actually had an admin tell me that this is exactly what the proper procedure is.

Doesn't matter what the vendor says. Sometimes they lose, sometimes we lose when it comes to BTC volatility. Even if their personal rules say one thing, the sites rules should trump them. Now, if you have bad relations with the vendor, I'd advise not ordering again, but I've literally never had a problem doing this.

Tbh usually vendors just work something out with the admins to split the coins. So don't be mad when it happen.
