Fake Doctor's Note

I was caught with 15 xans and spent the night in jail. Got released on Pre Trial. I have a legit klonopin prescription but not xanax. My questions are should I hire a lawyer (its my first offense, never been in trouble) or do you think if i complete the pre trial diversion program the judge will dismiss the charges? Also is getting a fake script that is dated before my arrest date worth a try? im thinking no because it will need a doctors signature...Any feedback appreciated

Submitting false evidence is a decidedly bad idea, unless you have a friend who is a doctor and is willing to have your back.

Think this through: would they really just look at the paper and say "rats, he's got us!"? Or would they subpoena the doctor and the pharmacy you made up/chose to check your story?

Always think three steps ahead.

Beyond that, I would hire a lawyer if a drug charge on your record would affect your life significantly. You need to weigh the benefits of hiring a lawyer with the cost of it, and that's not something any of us can do but you.

If you live in a state with first time offenders get a diversion treatment program, go for that; as that's what a lawyer you'd retain would say.

Your best bet is to do the diversion program, likely Drug Court, which will end with having the felony charges expunged. First - the most important advice is do not take legal advice of people on the internet.

Do not try to get a fake prescription. That is a crime in itself and will only add more serious problems to your fairly minor problem. They would absolutely check to see of it is legitimate, and you'd just end up having a few extra, more serious charges tacked on. It's not like a doctor note for work or school that they just look at and say "ok; no worries."

You absolutely need a lawyer. You do want to have a pretrial diversion or ARD, and a attorney will be able to negotiate this for you much, much better than you would be able to. These are very easy cases and generally don't cost that much money. If you are charged with a misdemeanor or higher and are legitimately unable to pay a private attorney, the court will appoint a public defender for you. The judge will decide if you qualify financially. At the end, the charges are typically dropped, and after some period the arrest record can usually be expunged as well. (depends on state.)

Note/ Public defenders are not hacks like people claim they are. I get genuinely upset by people spouting this off. They are typically fantastic defense attorneys since they argue these types of cases constantly. They know the local system, the judges, the usual outcome just as well or better than private attorneys.

Don't trust anyone except the attorney and do not talk to anyone but him. Take his advice; he is your absolute best ally and assuredly knows what he is doing and how to get you the best outcome. Ultimately you will end up with a clean record; however it is critical that everything is done correctly. Again, you truly need to use an attorney despite it being your first offense. You don't want to attempt do it yourself legal practice.

Lastly - don't worry or stress too much. It will come out just fine. Hundreds of thousands or people have been in your exact shoes before. You are only going to lose a small amount of money and a short amount of time that you are restricted. But it will pass and you'll come out the other side unscathed.

If you are approved for a pre-trial diversionaryh program often times the stipulations are that you do some type of drug testing, possibly some type of treatment iop or inpatient, and are not rearrested and the charges are dismissed.

I had a heroin cocaine and syringe possession and when all was said and done i was just charged iwth heorin posession and given a diversionary program and after a year of not being rearrested and passing a few drug tests the guilty plea waas vacated (I had to plead guilty to be allowed to apply to the diversoiary program, and if i had not been accepted to it, I would have a guilty plea in and would have walked away with 3 years probation.

Since I was acceptedto the program after a year the plea was vacated and charges dismissed. I then had to wait 18 months after that and I was allowed to exponge the arrest off my record.

Getting a fake script is the worst idea possible. 15 xanax bars is nothing - and will probably be dropped to a municipal charge as it stands.
