A partial analysis of US CBP Seizures that did not result in further prosecution so far this year

This might be of some interest to you guys. This comes from the civil forfeiture list. Being on the list indicates a CBP seizure at a port of entry, but does not indicate further prosecution (controlled delivery or referral to other agencies). This is only half of the whole list because the actual document dated June 29 is over 700 pages and all mixed up, so I gathered about half. All of these are from this year except a few cases.

This includes land borders, large shipping operations, as well as mail interceptions. I will have some observations but I don't want to make any conclusions, just data for you to peruse that may be of interest. CBP has a large amount of discretion as to what to do after a seizure and the list is ordered by customs office/port of entry. Again, partial list, and only substances that qualify under a controlled substance or are not FDA approved upon seizure.

These don't include criminal forfeitures but it gives you a picture of what amount gets you love letters (it varies) and where and what things are being seized at ports coming from overseas, for your reference.

How to read

2015529710017401-001-0000, Seized on 05/05/2015; At the port of MIAMI, FL; DIAZEPAM; 60; TB; Valued at $0.00; For violation of 19USC1595A(C),21USC952,355(A),381

2015529710017401-001-0000 is the case number. If two seizures have the same case number, they are seized at the same time from the same incident

Date and place are self explanatory. Port means any port of entry, not necessarily seaport

Name of drug may vary or be unidentified

Unit of measurement TB = tablets, GR = grams, KG = Kilos, EA = each (single pill), ampules, liters, etc. Different offices use different measuring and they're not necessarily consistent, but you get the idea.

Value: Seized drugs are usually not assessed for street value - it'd be impossible for consistency

Stated reason for seizure:

Note that an opportunity is afforded to fight the seizure, certainly, especially if it's a genuine misclassification or mistake.

Common ones: 19 USC 1595 Import in contrary to the laws of the US

(A) is stolen, smuggled, or clandestinely imported or introduced; (B) is a controlled substance, as defined in the Controlled Substances Act (21 U.S.C. 801 et seq.), and is not imported in accordance with applicable law; (C) is a contraband article, as defined in section 80302 of title 49;

21 USC 863

(a) In general It is unlawful for any person-- (1) to sell or offer for sale drug paraphernalia; (2) to use the mails or any other facility of interstate commerce to transport drug paraphernalia; or (3) to import or export drug paraphernalia.

21 USC 331 - catch all for importing and selling unapproved, unlicensed, foreign and unauthorized meds or foods or counterfeit drugs

21 UCS 381 importing drugs manufacturered in a facilities not authorized to export to the US

19 CFR ยง162.45a Summary forfeiture of Schedule I and Schedule II controlled substances.

21 USC 802(32)(A) - Schedule I and II analogue

21 USC 355 - Unapproved new drugs

19 USC 1526 - Fake drugs marked as genuine US drugs

18 USC 545 - Smuggling

Obviously land borders tend to get smaller amounts. This guy has the worst luck I'd imagine:

Steroids, cialis, viagra account for a lot of the seizures.
