Police asking for statement

Im from Australia, the police just turned up at my house and asked my girlfriend to let me know that they need a statement from me regarding some purchases I have made online. He said no one was in trouble, but obviously I feel a little anxious. Any help or direction would be appreciated.

Don't talk to them, a few years ago I was involved in an altercation. They came and I offered my side of the story.. just an open discussion, pretty informal. From that they came back and asked me to give a statement at the police station. At that moment I sought legal advice and it was determined that I would keep quiet until court. They still asked me a hundred questions to which I gave 'no comment' over and over. I thought that was it but a few weeks later I was summonsed to court.

Took almost a year to get the case heard and in the end I was justified in my actions and acquitted. If I had not spoken to them in the first instance I believe I would have had no case to answer for. I gave them evidence that I was there and I was part of the altercation etc. They used the information I gave willingly to build a case against me. Do not help them, let them come back and arrest you. They aren't going to do you any favours, they are bound by law to charge you if they think you have broken the law. Regardless of how nice you/they seem.

some questions they asked were very tricky 'Do you think you were right?' 'were you angry at what they did?' 'Did you think you were defending yourself?' All these questions are trying to record me saying I was there, I thought I was right.. angry etc. They can charge you with Aggravated Assault because you were angry and wanted revenge or whatever..

Just let them arrest you, if they have the evidence then they will. If they don't have the evidence then they will want to talk to you and 'have a chat'

Be aware that most of these people are from the US and don't know shit about how the Australian police/legal system works. They are doing you a disservice by offering lines straight from TV crime shows. Get some advice from someone who actually knows what they're talking about.

Remember, any sort of 'deals' or 'we'll lower your sentence if you cooperate' kinds of things, are NEVER a rush, you can always get back to them, and it's up to the prosecutor, NOT the police.

How did they find out? Did any of your packages not come in (what do you order, how often, what quantity?)?

Consult a lawyer who has specialty in this field, maybe there's some bitcoin advocacy group you could contact in AU for help on this matter.

Remember, don't incriminate yourself. They want to talk to you because they don't have evidence to charge you, so they have to talk to you in order to get you to admit to something stupidly and then charge you. If they had the evidence they needed, they wouldn't be asking your girlfriend, kindly. They have nothing on you, don't change that by talking to the police.

I would not recommend trying to contact the police, but maybe you should, I don't know, but I would strongly advise you tell them you don't recall on any definitive questions, and tell them you want an attorney present.

I wouldn't bother with a lawyer unless they actually arrest you. In which case still do not speak to the police until you have spoken to a lawyer.

Ok, I should start by saying that I live in the United States and do not know much about Australia law, so I am speaking based my knowledge and understanding of U.S. law. Keep this in mind.

First off, here's what I think happened: a seller on a Dark Net site, such as the Silk Road (https://silkroad6ownowfk.onion.to/), somehow got busted by law enforcement, and in order to lower their sentence or help themself in any way, legally speaking, they were told that they have to give out information relating to their crime, such as the names, addresses, and other contact information of people that they have done illegal business with, and I'm assuming that the person that you bought stuff from online just handed over to law enforcement a list of all of their customers and whatnot, which included your address (if they shipped stuff to you in the past), and now the police are trying to catch these people and arrest them and charge them, etc..

Now, my advice to you about the police coming to your house situation: NEVER IDENTIFY YOURSELF TO LAW ENFORCEMENT (including name, phone number, address, e-mail address, where you work and/or go to school, license plate number, Social Security number, driver's license number, etc.). This is very important, however, like I mentioned, I'm not familiar with Australia law, but I know in the U.S. you can legally deny any information and just remain silent whenever you want (under the fifth amendment to the United States Constitution). If you do have to speak, legally, then I would suggest denying any possible illegal activity, and do not release any information about what you have purchased online, especially from any Dark Net-type of site. Now, although some things are legal to do (such as not speaking here in the U.S.) doesn't mean the police won't lie to you and try to make you think there are laws that don't exist, or that laws that actually do exist, don't exist; this has happened to me personally when a cop told me that he had the right to search my car when in fact I knew he didn't. I refused any searches, and although it caused a whole hassle that lasted about 30 minutes, and another cop was brought to the scene, I got off without them searching my car and they never found the quarter-pound of marijuana under my car's back seat, along with a scale, lots of zip-lock bags, etc.. Anyways, make sure to study your local laws and any laws that might affect you and your current situation. This is very important as well, because knowledge of your laws will help you better understand what you can and can't legally do, say, and get away with. For example, if you find out that you too have the right to remain silent like we have here in the United States, that would likely be literally all you would need to get off worry-free, without any consequences. Avoid contact with them at all costs. Look through your door's peep-hole (if your door has one) and don't answer for anyone who you aren't expecting or don't know, especially law enforcement. In the U.S. at least, this is not illegal. Absolutely do not let them inside your home; no searches, no confiscations, none of that shit. If you get calls from people that you do not know, or you suspect them to be law enforcement, don't answer. If you do answer a call from law enforcement, you can always just hang up without saying anything; let them speak first. Lay low for a while. Keep windows and curtains closed, be especially observant and aware of your surroundings, and although you don't want to be paranoid, it's best to be aware of your surroundings (especially in your current situation) than ignore them and pretend everything is perfect. You shouldn't have to turn your whole life upside-down trying to avoid them, but you should take the necessary precautions before proceeding with your life. And if they really said "no one was in trouble", that's a huge scare right then; why would they be there if no one was in trouble? They don't just randomly show up at people's homes and question them if someone's not in trouble....

Well, that's about all the advice I can give. I am no professional, just a U.S. citizen who breaks the law multiple times daily and doesn't like getting caught, so I have learned a lot of things that may help in situations similar to the one you are in. Seems kinda sketchy to me that they would ask and leave. I am not from Australia so I can not speak honestly like I know the way the law works and how the police operate down there. However, my view on this is you should be fine. If they would of seized a package or had any legitimate proof you were ordering drugs you would be in handcuffs and they would not have left. Yes they are your friends. You're not in trouble. Yet. They just need a statement because some people are silly enough to have to ask on reddit what to do. Luckily it's not the AFP. Police only ask for a statement for good reason. They certainly don't visit to let you know you're not in trouble and are there for a chat. Do not acknowledge the visit. Clean house and and for Christ's sake think before you ask on the Internet.

You don't know what they are talking about, and if they want to discuss it further i.e. come down to the station please sir, you no comment their asses into the abyss and talk to your lawyer, explaining to him/her how these markets work and whether you have made yourself vulnerable or not, like if you didnt use pgp once or something.

Also remember that cops can not cut you a deal. Not sure how Australian legal system works, but in the us only the da can cut deals. Cops just like to blow smoke up your ass to get you to give em what they want. They are not your friends and don't care about you.
