It doesn't really matter if its fentanyl or not. From a legal standpoint, if you say its something illegal, it is. If you're sticking someone up in an alleyway and you tell them you have a gun, you get charged with possession of a firearm. If you sell baking soda to an undercover and say its cocaine, you get charged with distribution of narcotics.
Now, my question is why the fuck would the DA press charges for possession of fentanyl if they had no indications whatsoever that the substance was fentanyl? I mean they literally must have had no idea, the shit could have been cocaine.
