so if your caught with butyr, or any rc for that matter, they basically have to prove that you intended to use, or portay it as something for human consumption? is this right, basically in laymens terms?

If you are in the USA, the law says with analogs of Schedule I & II substances is that the feds will need to prove intent for human consumption.

Either way they would probably have an easy time convicting you in court for having butyrfentanyl which they would call an analog of acetylfentanyl or fentanyl. Acetylfentanyl is a schedule I substance. Fentanyl is a schedule II substance.

They would only theoretically need to prove intent to consume, which they would make a case for by proffering any number of flimsy-but-workable arguments such as - you had it in a baggie as drug users / dealers commonly do; the bag was not labelled as drug bags often aren't; the bag was labeled, but not properly, didn't meet legal standards, etc; you kept it with the rest of your drug stash, obviously because you intended to use it as a drug; you had syringes or other drug paraphernalia at home / on you; you don't have any legal / acedemic / research reason to be having this controlled substance analog other than for drug use; you don't have a job, implying you are selling drugs; you offered it for sale to someone else; you have a history of drug use; etc etc etc.

The reality: you cop a plea deal because you're gonna get fucked if you go to court.

The pragmatist thanks god these things are available because of weird laws but he treats them as if they are illegal drugs because in the eyes of DEA agents and prosecutors, they are.
